Villa rental contracts and deposits in Bali (2026)

Short answer. A villa rental in Bali is a private contract under the Indonesian Civil Code (KUHPerdata Art. 1548 ff.), and whatever you both sign binds you like law. No rule sets the deposit, so the contract has to: how much, what it covers, when it comes back. Yearly leases are usually paid upfront, so read every clause before the transfer.

What the law says about a villa lease

Indonesia's Civil Code covers renting (sewa-menyewa) in general terms. It doesn't have a special regime for villas, so most of what protects you is what you write down.

Article 1576 is the one to read twice. Some leases add a clause that lets the owner end the lease if the villa is sold. If yours has one, you've given up the protection the law gives you by default. Ask for it to come out, or for a notice period and a refund of prepaid rent if it stays.

On language, an English-only contract is not automatically void. The Supreme Court's guidance (SEMA 3/2023) says a missing Indonesian version is no ground to cancel it unless there was bad faith. A bilingual text still saves arguments later.

The deposit: what to write down

We don't publish deposit figures yet, and the law sets none. What we can say is how the money usually moves: our live pages show yearly leases are usually paid upfront, and the yearly listings we see mostly ask for the full year on signing, plus any deposit the owner adds.

That's a lot of cash in one transfer. For a 2-bedroom in Canggu at the September median, a year comes to Rp 300M. Before paying anything, get these into the contract:

Repairs, bills and the other clauses that cause trouble

The Civil Code leaves most day-to-day questions to the contract, so these are the ones worth spelling out:

  • Repairs. Who fixes what, and how fast: roof leaks, pumps, the pool, air conditioning, termite damage. Add what happens if a big repair isn't done, such as a rent reduction or the right to leave.
  • Bills. Electricity, internet, water, cleaning, pool and garden care, and any local banjar contribution. Included, capped or paid by you?
  • Land and building tax (PBB). The law lets the tax office bill whoever controls or uses the property, and the bill normally stays in the owner's name. Your lease should say who pays (UU 1/2022; Badung Perda 7/2023 Art. 6).
  • Early exit. On a prepaid year, what happens if you leave after five months? Without a clause, expect to lose the rest. On Canggu 2-bedroom medians, a yearly lease costs about the same as 8 months of monthly rent, which is the break-even to weigh against the risk (yearly vs monthly).
  • Construction next door. If building work starts nearby, can you ask for a discount or leave? Write the answer down now; it is much harder to agree later.
  • Pets, guests and subletting. Say what's allowed.
  • Renewal. A price or a formula for a second year, if you want one. An "agreement to discuss" gives you little.

Tax on the rent

Rent from a lease of land or a building carries a final income tax of 10% of the gross rent (PP 34/2017 Art. 2). If the tenant is a company or another appointed withholder, the tenant withholds it; otherwise the owner pays it (Art. 3). So a private tenant normally has nothing to withhold. A company renting a villa for staff does. Rent paid to an owner who isn't tax-resident in Indonesia is subject to 20% withholding, or a treaty rate (UU PPh Art. 26). Ask a tax adviser if your company is the tenant.

Who you're signing with

A lease only protects you as far as the other side's right goes. Before paying:

  • Ask to see the land certificate, and compare the name with the person signing. If they're renting to you but lease the land themselves, ask for their lease too, and check it runs longer than yours.
  • If a notary draws up the lease, check their registration on AHU Online (ahu.go.id). Notaries must by law act impartially (UU 2/2014 Art. 16(1)(a)), and if you don't understand Indonesian, the notary must translate the deed for you (Art. 43).
  • Be wary of anyone pressing for a transfer before you've seen the villa and the contract.

FAQ

How much is the deposit on a villa rental in Bali?

There's no legal standard, and we don't publish a typical figure. The deposit is whatever the contract says. Write down the amount, what it covers, the return date and how deductions are agreed.

Can the owner end my lease if they sell the villa?

Not by default. Under KUHPerdata Art. 1576 a sale doesn't end an existing lease unless the lease itself says so. Check your contract for a sale clause before you sign.

Do I need a notary for a villa lease?

A notarial deed gives the lease full evidentiary force if there's a dispute (KUHPerdata Art. 1870). That matters most when you're prepaying a year or more. Choose your own notary and check them on AHU Online.
